General Contract for Photography Services
Deposit/Cost
The booking fee is due on the signing of this agreement, which is $50 per session. It is a non-refundable retainer and is due to reserve your date. The remaining balance is due within at least 7 days after the photos have been taken. No photos will be returned without your payment in full.
Entire Agreement
This is a contract for photography services to be provided by Carmody Lee Photography and/or individuals subcontracted to do work for Carmody Lee Photography. It contains the entire understanding between the Clients and the Photographer. Please continue reading for all terms and conditions.
Confirmation
“General Contract for Photography Services” and payment of the booking fee are required to confirm the stated services from the Photographer.
Cooperation
The Clients and the Photographer consent to cheerful cooperation and communication with each other in order to achieve the best possible result within the understanding of this contract. The Photographer has the right to leave the photoshoot if put in any uncomfortable situations, the same goes for the client. The Photographer will do their very best to capture beautiful photos of the family, please note that especially with children they are not always comfortable and do not always want to smile, they can also downright refuse to be photographed and this is not the responsibility of the Photographer. The photographer is not responsible in providing any outfits for this photoshoot unless they have otherwise stated.
The Schedule
Our shooting schedule, style of working, and experience are designed to achieve a great set of photos for the Clients, accomplished with good humor and enjoyed by all concerned. Both the Clients and the Photographers, therefore, agree that punctuality and cooperation are essential to producing outstanding photographic results. In cases where the someone may be late we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate.
Copyright
The copyright of photographs remains with the Photographer. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication, or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. If you do not want photos posted on photographers social media or used as advertising purposes please inform your the photographer of this in advance.
Model Release
The Client grants the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising, and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs, and assigns from all liability and claims in connection with the images.
Limit of Liability
The Photographer has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen, or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
Cancelation and booking fee/deposit
In the event of the Clients canceling for whatever reason, the booking fee is non-refundable; your deposit becomes a "studio credit" and may be used toward a future session or event.
Weather
The Photographer keeps a constant eye on the weather in the upcoming week prior to your photoshoot. They will inform you if they feel as though they have to reschedule the session. Typically anything over %50 chance of precipitation is rescheduled. The photographer can not predict cloud cover or fog and will continue the photoshoot in those conditions. If the Photographer has traveled to the location and there is overcast or fog and the client wants to reschedule the services can be rescheduled but there will be a $25 rescheduling fee and km's will be paid for any locations outside of HRM.
Changes to event during services
Please advise Photographer prior if there are any changes to location, if locations change during the event that the photographer was not aware of and has to travel there is a per kilometer charge that can be found under the pricing section. If Photographer shows up to location and was not advised of cancelation or if clients decide last they want to change the location when Photographer is on location there will be a per hour travel fee of $50 per hour.
